Respondent Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records of the respondent impugned rejection order in Application No.2025/0105/05/343943 dated 26.07.2025, and to quash the same as illegal and consequently to direct the respondent to grant sub division patta transfer in favour of the petitioner in respect of property in Dharmapuri District in Pennagaram Taluk in Ramakondahalli Village in S.No.335/2A, 336/2A1, 336/2B1, 336/2C1 & 336/2C2B.

This writ petition has been filed challenging the respondent's order passed in Application No.2025/0105/05/343943 dated 26.07.2025, thereby rejected the request made by the petitioner for sub division and patta in respect of the subject property.
2. Heard the learned counsel appearing on either side.
3. According to the petitioner, his father owned the subject land and while he was alive, the subject property was partitioned between the family members by the partition deed dated 13.02.2019. Accordingly, the petitioner submitted application for sub division and issuance of patta. However, it was rejected only on the ground that the petitioner's brothers and sisters raised objections. Though they raised objections, the respondent did not conduct any enquiry and merely on receipt of their objections, the request of the petitioner has been rejected.
4. In view of the above, the impugned order cannot be sustained 2/4
and the same is liable to be set aside. Accordingly, the impugned order dated 26.07.2025 is set aside. The respondent is directed to conduct enquiry on the application submitted by the petitioner for sub division and patta in respect of the property in Dharmapuri District in Pennagaram Taluk in Ramakondahalli Village in S.No.335/2A, 336/2A1, 336/2B1, 336/2C1 & 336/2C2B, and, after issuance of notice to the petitioner and the aforementioned objectors and giving them opportunity of personal hearing, to pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.
5. With the above direction, this writ petition stands allowed. There shall be no order as to costs.
