The suit has been filed for infringement of design and passing off. 2.The plaintiff is having its Branch Office at Chennai and the products are being sold at Chennai. Since a part of cause of action has arisen at Chennai, this Application has been filed seeking to leave to sue the defendant, who is carrying on business at Karnataka, which is outside the jurisdiction of this Court. 3.This Court, after giving due consideration to the contents of the affidavit filed in support of this application, is inclined to grant leave to sue as prayed for. 4.Accordingly, this application is allowed and the leave to sue is granted as prayed for.
