Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the respondents 1 and 2 to include the name of the petitioner under NRI Quota in the 2nd Round of counseling for NEET UG 2025, consequently allow the petitioner to participate in the remaining rounds of counselling. ORDER

This Writ Petition has been filed seeking a direction to the first and second respondents to include the petitioner's name under the NRI quota in the second round of counselling for NEET UG 2025.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner, after completing his Higher Secondary Education, applied for NEET and secured 119 marks. Based on his eligibility, he participated in the counselling for the MBBS course before

the fifth respondent under the general quota. After completion of the first round of selection, the first respondent issued a notification dated 02.09.2025, stating that the candidates who had participated in the first round of counselling could apply under the NRI quota. Accordingly, on 03.09.2025, the petitioner submitted an application along with all necessary documents. Thereafter, the list of candidates selected under the NRI quota was published, in which the petitioner's name was not found. Therefore, the petitioner submitted a representation, which was not considered. Hence, the petitioner has approached this Court.

On written instructions, Mr.K.Srinivasamurthy, learned Special Panel Counsel appearing for the respondents 1 and 5 submitted that certain deficiencies were found in the documents furnished by the petitioner, due to which his application for conversion under the NRI quota was rejected. The name in the bank statement and bank details provided did not match the Sponsor Certificate and the Relationship Certificate. The petitioner is now sponsored by Ms.Victoria Santiago, holder of an Indian Passport, who is residing in Taipei. The concerned authority has also issued a Relationship Certificate.

5. A perusal of the Relationship Certificate reveals that the sponsor's name was mentioned as Mrs.K.Victoria, w/o.Santiago, which refers to her own husband. Accordingly, the NRI certificate issued by the Indian-Taipei Association stands in the name of Ms.Viktoria Santiago and also includes the name of her husband. It cannot be construed as any deficiency. It is common in our country for a wife's name to be mentioned either with or without adding the husband's name.

6. In view of the above, the fifth respondent is directed to consider the candidature of the petitioner under the NRI quota in the second round of counselling for NEET UG 2025 and permit him to participate in the remaining rounds of counselling.

7. With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. No costs.
