Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus to direct the 1st respondent bank not to proceed further under SARFAESI Act, 2002 pending disposal of the SA before the Hon'ble Debts Recovery Tribunal, Coimbatore in SA No.104 of 2024 as against the Section 14 of SARFAESI Act, 2002 order in Cr.M.P.No.29477 of 2024 vide order dated 29.01.2025 order passed by the Hon'ble Chief Judicial Magistrate, Coimbatore.

(Order of the Court was made by the Hon'ble Chief Justice) This petition is absolutely frivolous as it seeks indulgence of the Court despite the blameworthy conduct on the part of petitioner in withdrawing Rs.1.00 crore, subject to deposit of which interim order was passed by Debts Recovery Tribunal in favour of petitioner.

2. Petition is dismissed. This order shall not come in the way of petitioner approaching Debts Recovery Tribunal for such relief which he claims. Consequently, the interim application is also dismissed.
