ORDER
This writ petition has been filed in the nature of a mandamus seeking a direction to the respondents to consider and dispose of the application of the petitioner dated 19.09.2024, 22.09.2024 and 23.09.2024 to furnish about six documents which had been listed in the writ petition.
2.In the affidavit filed in support of the writ petition, it had been stated that the petitioner and the other residents at Medavakkam Main Road in Adambakkam have formed an Association called Medavakkam Main Road Resident Welfare Association. It has also been registered vide Registration No.458/2008 under the Society Registration Act. It had been contended that the property in Old Survey Nos.50, 99, 100, 101 in new Survey No.104/1, part measuring to an extent of 10 Acres 61 cents was acquired by the Government on 01.09.1965. It was stated that the land was allotted for public purpose for the provision of houses to the Harijans. It was also stated that the property has to be allotted to more than 168 persons with each getting one ares of land. It was also stated that the property has now been declared as a lake property and therefore, it has to be acquired by the revenue authority. It is contended by the petitioner that the property is
not a lake property. In this connection a suit had also been filed in O.S.No.204 of 2022 on the file of the Additional District Munif at Alandur. It is therefore contended that documents viz., (i)Na.Ka.No.1704A1/2019 dated 17.12.2019 (ii) Na.Ka.No.49/2019 dated 07.05.2019 (iii) Na.Ka.No.49/2019 dated 25.11.2021 (iv) Number 136 Inam Sketch, Adambakkam Village (v) Na.Ka.No.49/2019 dated 06.09.2021 (vi)Report given by the Sub Inspector dated 31.05.2021 have to be furnished to the petitioner herein. He had given representations, but since the documents had been not furnished, the writ has been filed.
3.Instructions had been obtained by the respondents and it had been stated that Document No.(i) had already been addressed to the petitioner herein and it is contented that it had been served on the petitioner. At any rate a copy of the same is handed over to the learned counsel for the petitioner. With respect to the other documents, it had been stated that Inam Sketch of Adambakkam Village which is No.136 and S.No.(iv) is not maintained in the Taluk Office. Therefore, the petitioner will have to approach the appropriate office seeking copy of the same. With respect to Document in Na.Ka.No.49/2019, it had been stated that it had been registered in the name of K.Shyamala Paul at No.122 , 27th Street, Nanganallur, Chennai 16 and pertains to Block 23 of Ward B. It has therefore been stated that, that particular document is not available in the office of the respondents. It had been further stated that the Assistant Director of
Survey and Land Records and Personal Assistant to the Collector, Chennai had been requested to furnish the status of the documents. 4.The writ petition stands disposed of with a direction to the petitioner to apply afresh to the office of the Collector, Chennai seeking copies of the said documents. The respondents do not have a copy of the documents and it is stated that the respondents have themselves addressed the office of the Collector, Chennai for the documents. Let a fresh application to be made to the Collector, Chennai seeking copies of the said documents.
