It is submitted that the fourth respondent in the appeal died. 2.C.M.P.Nos.29529, 29531 & 29532 of 2023 are filed to substitute the legal heirs of the deceased as respondents 6 & 7 in the appeal, to set aside the abatement and to condone the delay of 138 days in filing the application to set aside the abatement.
3.There is no objection on the side of the appellant as well as other respondents for allowing these petitions.
4.Perused the affidavits filed in support of these petitions and satisfied with the reasons, these Civil Miscellaneous Petitions are ordered. 5.Registry is directed to carry out the necessary amendment. 6.It is also submitted by the parties that a compromise proposal is underway and they will be able to finalize and report the settlement before this Court on 30.01.2024.
