ORDER
The relief sought for in this writ petition is to direct the second respondent to consider and dispose the petitioner's representation dated 07.07.2025 in accordance with law and thereby direct the second respondent to remove the fourth respondent name from the patta bearing No.177 for the property comprised in Survey No.52/6, situated at Renganathapuram Village, Valangaiman Taluk, Tiruvarur District.
2. Mr.R.P.Murugan Raja, learned Government Advocate takes notice on behalf of respondents 1 to 3. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.
3. The case of the petitioner is that the petitioner has purchased two agricultural lands comprised in S.No.52/5, to an extent of 0.42 cents 2/6
and S.No.52/6, to an extent of 0.75 cents, situated at Renganathapuram Village, Valangaiman Taluk, Tiruvarur District. For the said survey No.52/6, patta No.177 was issued to the petitioner. This being the case, in the year 1996, the petitioner's brother also purchased an agricultural land comprised in S.Nos.47/3 and 50/1, situated at Renganathapuram Village, Valangaiman Taluk, Tiruvarur District. After his demise, the petitioner's brother's wife, the fourth respondent herein made an application for transfer of patta to her name. However, the third respondent mistakenly removed the petitioner's name and included the name of fourth respondent in the patta No.177, bearing S.No.52/6. 3.1. Thus, the petitioner sent a representation dated 07.06.2019 to remove the name of fourth respondent and to issue patta in favour of petitioner.
For which, the third respondent ordered to include the petitioner's name in the said patta and failed to remove the fourth respondent's name. Therefore, the petitioner made a representation dated 07.07.2025 before the second respondent to remove the name of fourth respondent from the said patta, however, till date, no order was passed. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the second respondent to consider the petitioner's representation dated 07.07.2025.
5. Learned Government Advocate appearing for the respondents 1 to 3 submitted that the petitioner's representation dated 07.07.2025 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the second respondent to consider the petitioner's representation dated 07.07.2025, after giving due notice and opportunity of personal 4/6
hearing to the petitioner as well as fourth respondent and aggrieved persons, if any and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With the aforesaid direction, this writ petition is disposed of. No costs.
