ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.08.2025 for the alleged offence punishable under Section 5 of Explosive Substances Act, 1908 in Crime No.318 of 2025 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused had illegally transported 75 boxes of Gelatin sticks. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner was not in possession of any explosive substances. A4 was found in possession of explosive substances and based on the confession statement of co-accused, the petitioner has been falsely implicated in this case. Hence, he prayed to grant bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner is a regular offender and he has already involved in two previous cases of similar nature. In this case, A2 to A5 and A7 are still absconding and investigation is at preliminary stage. Hence, he strongly opposed to grant bail to the petitioner. 2/4

5.Heard both sides and perused the materials available on record. 6.Considering the fact that A2 to A5 and A7 are still absconding and the petitioner was arrested only on 26.08.2025 and is having two previous cases of similar nature, I am not inclined to grant bail to the petitioner at this stage.
