This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.257 of 2024 on the file of the respondent Police.

Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record. 3.

The petitioner is arrayed as an accused in Crime No.257 of 2024, registered on the file of the respondent Police, for the offence under Sections 4(1)(a), 4(1)(i) and 4 (1-A) of TN Prohibition Act, for allegedly being in illegal possession of 10 bottles of brandy (each 180 ml) containing spurious substances.

The said FIR is sought to be quashed on the ground that the case was registered on 02.07.2024 and till date, there has been no progress in the investigation, which is still pending. On perusal of the First Information Report, it is seen that the seized liquor was mixed with certain medicinal substances intended to cause inebriation. The prosecution has submitted that the samples taken from the seized contraband have been sent to the Forensic Science Laboratory for examination and the report is awaited.

In view of the above, at this stage, pending receipt of the forensic report from the lab, this Court does not find any merits to quash the proceedings and holds that it is a fit case where further investigation ought to be conducted.
