COMMON ORDER The petitioners, who were arrested and remanded to judicial custody on 19.08.2025 for the alleged offence punishable under Section 309(4) of BNS, 2023 in Crime No.463 of 2025 on the file of the respondent police, seek bail. 2.The petitioner in Crl.O.P.No.25807 of 2025 is ranked as A3 and the petitioner in Crl.O.P.No.25828 of 2025 is ranked as A4. The case of the prosecution is that the petitioners joined hands with 4 other accused conspired and while the de-facto complainant was waiting in a public place along with cash of Rs.79 lakhs, these petitioners went there, attacked him and robbed the amount.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners have no previous cases. Hence, prays to grant bail to the petitioners.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police reported that there are totally 6 accused in this case and the petitioners robbed a sum of Rs.79 lakhs, out of which, from A3, Rs.12 lakhs recovered and from A4, Rs.2 lakhs recovered. Totally, by arresting 3 persons, a sum of Rs.17 lakhs alone recovered and remaining amount yet to be recovered. Some of the other accused also absconding. Hence, strongly opposed to grant bail to the petitioners.

5.Considering the fact that the investigation is not yet concluded and majority of the money is yet to be recovered and it is also shown that the petitioners are also involved in this case and recoveries also effected from them, I am not inclined to grant bail to the petitioners. 6.Hence, these Criminal Original Petitions stand dismissed. 19.09.2025 rsi 3/4
