Read this in conjunction with and in continuation of earlier proceedings dated 21.01.2020 and 24.01.2020.

2. Vide 21.01.2020 proceedings, an affidavit inter alia setting out the schedule of payments had to be filed besides tendering of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only).

3. Tendering of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) was done on 24.01.2020 and this is captured in order/proceedings dated 24.01.2020.

4. Today an affidavit though captioned 'COUNTER AFFIDAVIT FILED BY THE 1st RESPONDENT', being an affidavit dated 28.01.2020 has been filed and the schedule of payments has been set out in paragraph 9 of the affidavit which reads as follows:

'9. I submit that in the above stated change of circumstances, I need further time to mobilise funds and repay the balance amounts of Rs.40 Lakhs to the applicant. I will pay

1. a sum of Rs.15 Lakhs on or before 29.02.2020.

2. a sum of Rs.25 Lakhs on or before 31.03.2020 as final payment'.

5. It is submitted on instructions that the first respondent will adhere to the above schedule without any breach.
