The petitioner, who was arrested and remanded to judicial custody on 20.08.2025, for the offences punishable under Sections 123 of BNS, 2023 and Section 24(1) of The Cigarette and other Tobacco Products Act, 2003 in 1/4
connection with Crime No.480 of 2025, on the file of the respondent, seeks bail.
2.The case of the prosecution is that Accused No.1 had illegally transported around 40 kgs. of banned tobacco products in a Tata Indica car. On his arrest, he confessed that the tobacco products were about to sell to the petitioner and other persons. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and based on the confession of co-accused/A1, the petitioner has been falsely implicated in this case. He further submitted that the co-accused/A1 was granted bail by this Court in Crl.O.P.No.24189 of 2025 on 11.09.2025. Hence, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that the petitioner has got two previous cases of similar in nature and the co-accused/A1 has got no previous cases.

5. Heard both sides and perused the materials available on record. 6.Considering the nature of allegations and the fact that the petitioner has got two previous cases of similar nature, I am not inclined to grant bail to the petitioner.
