ORDER
The writ petition is filed to direct the respondents to consider and dispose of the petitioner's representation dated 01.08.2024 within a time frame to be fixed by this Court.
2. It is the case of the petitioner that he had joined the respondent-Mill as a Shift Supervisor on temporary basis on 03.10.1996. He has rendered 28 years of blemishless service in the respondent spinning Mills. During the year 2007, the post of Assistant Spinning Master (Quality Control) and (Maintenance) became vacant due to the resignation of one S.Balaji and K.Valli Nayagam. The post of Factory Manager has also been vacant since 2007. He would further submit that, as per Subsidiary Regulation 17(a), the post of Shift Supervisor is the feeder post to the post of Assistant Spinning Master. An employee who has completed five 2/6
years of service as a Shift Supervisor is eligible for promotion to the post of Assistant Spinning Master. However, the respondentManagement decided to fill up the said posts on contract basis without considering the requests of the in-service employees. Subsequently, one A.Charles Vijay was appointed on contract basis from June 2008 and the said arrangement continued on a yearly basis till 2012. His services were regularised by the respondent by order dated 01.08.2012 in violation of the applicable Rules. Neither a Recruitment Committee was appointed nor a Board Resolution passed for appointing him as a regular employee.
3. According to the petitioner, the respondent-Management is filling up the posts on contract basis without considering eligible in-service candidates and has violated the rule of reservation. In this regard, he had made a representation dated 01.08.2024 to the Chairman-cum-District Collector and the Managing Director of the respondent Mill. However, his request has not been considered so 3/6
far. Hence, the petitioner is before this Court.
4. Heard the learned counsels on either side and perused the materials available on record.

Considering the facts and circumstances of the case, particularly the fact that posts are being filled upon contract basis ignoring in house candidates a mandamus is issued to the respondents to consider the representation of the petitioner dated 01.08.2024, and pass orders on merits and in accordance with law within a period of two months from the date of receipt of a copy of this order.
