ORDER

This Criminal Original Petition has been filed to direct the respondent police not to harass the petitioner in any manner.

2. The learned counsel for the petitioner has submitted that the 2nd respondent has registered a case against the petitioner's son in Crime no.16 of 2019 under sections 417, 376 IPC. He further submitted that no case is registered against the petitioner. The 2nd respondent is unnecessarily calling the petitioner daily and harassing the petitioner under the guise of enquiry.

Per contra the learned Additional Public Prosecutor has submitted that since the petitioner's son is involved in a grave crime and he is absconding, only for the purpose to know about the whereabouts of the petitioner's son, the petitioner was called for enquiry and he was not subjected to any harrassment.

4. Considering the fact that since the petitioner's son is involved in a grave crime and he his absconding, certainly the respondents are entitled to enquire with the petitioner to ascertain the whereabouts of the petitioner's son and the said enquiry cannot be treated as harassment. This court finds no merits in this case and it is liable to be dismissed.

5. Considering the aforesaid facts, the criminal original petition is dismissed.
