The name of the first respondent has been printed in the cause list. However, there is no representation for the first respondent either in person or through a counsel.

2. The second respondent is represented through a counsel.

3. This Civil Miscellaneous Petition has been filed seeking to condone the delay of 420 days in filing the Civil Miscellaneous Appeal.

4. Heard the learned counsel on either side and perused the records.

5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 420 days in filing the above appeal is condoned.

Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course. Registry is directed to print the name of Mr.B.Sivakolappan, learned counsel for second respondent, at the time of admission.

It is made clear that for the period of delay of 420 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
