Respondent(s) PRAYER; This writ petition has been filed under Article 226 of Constitution of India, to issue a writ of Mandamus, declaring the inaction on the part of the 1st and 2nd Respondents in refusing to reissue the Petitioners Passport bearing No. V9405738 is illegal and arbitrary and consequently direct the 1st and 2nd respondents to reissue above mentioned Passport to the Petitioner.

ORDER
This writ petition has been filed to declare the inaction on the part of the 1st and 2nd Respondents in refusing to reissue the Petitioners Passport bearing No. V9405738 is illegal and arbitrary and consequently direct the 1st and 2nd respondents to reissue above mentioned Passport to the Petitioner.
2. It is the case of the petitioner that in the year 2007, the petitioner married to one Jayanthi the daughter of one Muniyan. Out of the wedlock, they blessed with two children. Due to different of opinion, the couple were living separately. The petitioner obtained a passport in the year 2002 which is valid for 2002 to 2032. After separation, the petitioner's father in law had lodged a complaint before the third respondent. Without proper enquiry, the third respondent registered a case in Cr. No.265/2016 alleged offence under Section 296(b), 326, 406(2), 307 of IPC and the same is pending. Subsequently, the petitioner joined with his wife and living together.
3. That being the factual situation, the petitioner lost his passport recently and on 11.04.2025, the petitioner made an online application beore the first
respondent along with necessary payment for reissue of the passport and the same was not considered. Hence, the present writ petition.
4. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners application within the stipulated time as fixed by this Court.
5. The learned Standing Counsel appearing for the respondents 1 & 2 submitted that the application will be considered and orders will be passed within the stipulated time as fixed by this Court.
6. Heard the learned counsel for both side and perused the materials available on record.
7. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's application dated 11.04.2025 within a period of six weeks from the date of receipt of a copy of this order.
8. With the above directions, the writ petition is disposed of. No costs. 10-10-2025 rli
