ORDER

The petitioner, who was arrested and remanded to judicial custody on 31.08.2025, for the offences punishable under Sections 126(2), 296(b), 115(2), 118(1), 109,311, 351(3) of BNS Act in Crime No.441 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioners joined hands with other accused and robbed a sum of Rs.650/- from the defacto complainant. Hence, this case.

The learned counsel appearing for the petitioners submitted that co-accused in this case is released on bail by the Sessions Court in Crl.M.P.No.8550 of 2025. He also submitted that this petitioners only accompanied the other accused at the time of occurrence. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the 2/4

prosecution case and states that the first petitioner has 3 previous cases and the second petitioner has seven previous cases.

5. On perusal of records it is found that the co-accused who was released on bail in Crl.M.P.No.8550 of 2025 has no previous cases, whereas the petitioners herein has previous cases. 6.

Considering the facts, gravity of offence and the fact that the bad antecedent of the petitioners herein, this Court is not inclined to grant bail to the petitioner.
