The petitioner was arrested and remanded to judicial custody on 20.08.2024 for the offences punishable under Sections 64(2)(h), 64(2)(m) and 351(3) of BNS, 2023 r/w Section 5(1), 5(j)(ii), 4(2) and 6(1) of Protection of Child from Sexual offences Act in Crime No.16 of 2024, on the file of the respondent Police, seeks bail.

The case of the prosecution is that the petitioner is aged about 62 years and the victim used to visit his shop and taking advantage of her innocence, petitioner had enticed the victim girl and committed penetrative sexual assault against her, not once, but on several occasions, due to which the victim girl become pregnant. Hence this case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide any condition as imposed by this Court and seeks for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the victim girl had delivered a baby, and the DNA report confirmed that the petitioner was involved in the offence. Hence, he strongly opposed for grant bail to the petitioner. 2/4
5. In view of the fact that the DNA report had confirmed the petitioner's involvement in the offence, this Court is not inclined to grant bail to the petitioner.
