ORDER

These applications have been filed to extend the time by 12 months to enable the Arbitrator to complete the arbitration proceedings as between the applicant and the respondents.

2.A detailed counter affidavit has been filed by the 6th respondent in A.No.6324 of 2024 and respondents 6 and 7 in A.Nos.6328 & 6329 of 2024.

3.The application is opposed by the learned counsel for the respondents 6 and 7 in the above applications and all the other respondents have already been served by way of substituted service. The case of the contesting respondent is that because of the prolonged hearings and continuation of the arbitration proceedings, the said respondent is not in a position to pay the fees of the Arbitrator, as well as the expenses in connection with the proceedings. In fact, in the counter affidavit, the respondent has categorically stated that the respondent is not against the extension of the arbitration proceedings.

4.In view of the above and also considering the submission of the learned counsel for the applicant that the applicant is willing to meet the fees of the Arbitrator from the date of extension onwards, the above applications are ordered. The mandate of the Arbitrator is extended by six months from today. It is made clear that all expenses going forward from today including the fees of the Arbitrator and expenses for the venue and other miscellaneous expenses shall be made by the applicant. 27-01-2025 ata Note: Issue order copy on 28.01.2025.
