This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 75 days in filing the above Criminal Appeal against the judgment dated 14.03.2025 passed in S.C.No.01 of 2024 on the file of Special Judge (under POCSO Act, 2012), Karaikal.
2. Mr.M.Mohamed Saifulla, learned counsel for petitioner submitted that due to his poverty condition and misplace of case records, he is not able to take steps for filing the appeal and he approached the High Court Legal Service Committee and they have nominated the counsel on record. Thereafter, during month of July 2025, he gave papers to him, as a result of which, there is a delay of 75 days in filing the above Criminal Appeal arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Appeal.
3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
