ORDER

Apprehending arrest in connection with Crime No.414 of 2025 registered for the offences punishable under Sections 189(2) and 132 of BNS, 2023 r/w Section 4B of Tamil Nadu Open Places (Prevention of Disfigurement) Act, the present petition has been filed by the petitioners seeking anticipatory bail.

2.The allegation against the petitioner is that the petitioner along with others had erected advertising Boards/Digital banners near bus stand and in public places. When the same was questioned by the officials of the Municipality, the petitioner along with others had abused filthy language and threatened the de-facto complainant as well as the officials of the Municipality with dire consequences. Hence the complaint. 3.Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4.The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioners along with others had erected advertising Boards/Digital banners near bus stand and in public places and the same was questioned by the Officials of the Municipality, the petitioner along with others had abused filthy language and threatened the de-facto complainant as well as the officials of the Municipality with dire consequences. He further submits that five previous cases are pending against the petitioner and others similar in nature. However, he opposed for grant of anticipatory bail to the petitioner. 5.Taking into the submissions made by the learned Government Advocate (Criminal Side) appearing for the respondent/state, considering the gravity of the offence committed by the petitioner and others and considering the fact that five previous cases are pending against the petitioner & others similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 3/6
