ORDER
This writ petition has been filed to direct the 2nd respondent to rectify the error in the FMB Sketch as per the rectification deed Doc. No.2727/ 2024 dated 22.07.2024 through disposing the appeal presented by the petitioner dated 01.07.2025.
2. Mr.R.P.Murugan Raja, learned Government Advocate, takes notice on behalf of the respondents.
3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.
4. The learned counsel for the petitioner would submit that in this case, the petitioner has purchased the subject property vide sale deed dated 15.09.2021. Thereafter, he applied for issuance of separate patta in respect of the subject property. However, the said application was 2/7
rejected by the 4th respondent without assiging any reasons. The said rejection was challenged before this Court in WP.No.7055 of 2024, hwereby a direction was issued to the 4th respondent to conduct an enquiry and issue separate patta. Subsequently, the petitioner came to know that there is a measurement error in FMB Sketch of the subject property. Hence, the petitioner executed a rectification deed to rectify the boundary description vide Doc.No.2727/2024 dated 22.07.2024. In this regard, a representation was made before the 3rd respondent on 03.01.2025. The said representation was rejected by the 3rd respondent on the ground that both the petitioner and the adjacent land owner have same four boundaries in their registered documents and advised the parties to approach Civil Court. Against the rejection order, an appeal was preferred by the petitioner before the 2nd respondent on 01.07.2025. However, no action has been initiated to dispose of the said appeal till date. Hence, this writ petition.
5. In reply, the learned Government Advocate appearing for the respondents would request this Court to pass appropriate orders 3/7
directing the respondents to consider and dispose of the appeal filed by the petitioner.
6. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents and also perused the materials available on record.
7. In the case on hand, the petitioner has purchased the subject property vide sale deed dated 15.09.2021. Thereafter, he applied for issuance of separate patta in respect of the subject property. Subsequently, the petitioner came to know that there is a measurement error in FMB Sketch of the subject property. Hence, the petitioner executed a rectification deed to rectify the boundary description vide Doc.No.2727/2024 dated 22.07.2024. In this regard, a representation was made before the 3rd respondent on 03.01.2025. The said representation was rejected by the 3rd respondent on the ground that both the petitioner and the adjacent land owner have same four 4/7
boundaries in their registered documents and advised the parties to approach civil Court. Against the rejection order, an appeal was preferred by the petitioner before the 2nd respondent on 01.07.2025. However, no action has been initiated by the respondent to dispose of the said appeal till date.
8. In view of the above, this Court directs the respondents to consider the petitioner's appeal dated 01.07.2025 and dispose of the same on merits and in accordance with law within a period of 4 weeks from the date of receipt of copy of this order.
9. With the above directions, this writ petition is disposed of. No costs.
