ORDER
The petitioner, who was arrested and remanded to judicial custody on 04.08.2025 for the alleged offences punishable under Sections 296(b), 118(2), 351(2) and 303(2) of BNS, 2023, in Crime No.539 of 2025 on the file of the respondent police, seeks bail.
2. The allegation is that the petitioner leading a mob claiming himself as leader of a political party, and while another political party group came in the opposite direction, this petitioner joined hands with some more accused attacked the defacto complainant and some other using PVC pipe and various deadly weapons.
3. The learned counsel for the petitioner submitted that the petitioner is in custody from 04.08.2025 and since he is named in the FIR, he was alone arrested and injured has been discharged from the hospital.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reported that this petitioner, who is a habitual offender and claiming himself as a leader of political party, attacked the opposite party, 2/4
who came in the opposite direction for celebrating function in the common place. He further submitted that the petitioner is involved in three previous cases including a case of murder.
5. Considering the bad antecedents of the petitioner including the case of murder and the other accused were absconding, this Court is not inclined to grant bail to the petitioner.
