Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents herein to permit the petitioner herein for duty immediately and treat the period of nonperformance of duty from 07.09.2025 to date of admitting for duty as "duty for all purposes" in the petitioner's service, by considering the representations of the petitioner dated 09.09.2025 and 10.09.2025 to the 1st respondent and 09.09.2025, 11.09.2025 and 12.09.2025 to the 2nd respondent.

ORDER

This writ petition has been filed seeking to direct the respondents to to permit the petitioner for duty and to treat the period from 07.09.2025 till the date of admitting for duty as "duty for all purposes" in the petitioner's service, by considering his representations dated 09.09.2025 and 10.09.2025 sent to the 1st respondent and the representations dated 09.09.2025, 11.09.2025 and 12.09.2025 sent to the 2nd respondent.

2. Mr.S.Sivasubramani, learned counsel takes notice on behalf of the 1st respondent. In view of the consent expressed by the learned counsel on either side, this writ petition is taken up for final disposal at the admission stage itself.

3. The case of the petitioner is that, he joined the services of the respondent corporation as a Driver-cum-Conductor on 29.12.2016 and subsequently, his services were regularised on 17.09.2016 and the petitioner 2/6

was working at Tirunelveli Depot till 06.09.2025. While so, all of a sudden, on 07.09.2025, when the petitioner went to work, he was not permitted to perform duty and despite several requests made by the petitioner in person, before both the respondents, he was not permitted to join duty. Aggrieved by the same, the petitioner made representations before the 1st respondent on 09.09.2025 and 10.09.2025 and also made representations before the 2nd respondent on 09.09.2025, 11.09.2025 and 12.09.2025, respectively, seeking to permit him to join duty. However, till date, no orders have been passed on the said representations. Hence, the petitioner has come up with this writ petition.

Learned counsel for the petitioner submits that, it would suffice, if this Court issues a direction to the respondents to consider the petitioner's representations dated 09.09.2025, 10.09.2025, 11.09.2025 and 12.09.2025 and consequently, permit the petitioner to join duty, as expeditiously as possible and also to further direct the respondents to treat the period from 3/6

07.09.2025 till the date of admitting him for duty as "duty for all purposes" in his service.

5. Learned counsel appearing on behalf of the 1st respondent submits that appropriate orders will be passed on the petitioner's representations within the time stipulated by this Court.

Considering the limited prayer now sought by the learned counsel for the petitioner and the aforesaid submission of the learned counsel for the 1st respondent, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representations dated 09.09.2025, 10.09.2025, 11.09.2025 and 12.09.2025 and pass appropriate orders on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order, after affording opportunity of hearing to the petitioner and aggrieved persons, if any. 4/6

7. With the above directions, this writ petition stands disposed of. No costs.
