ORDER

Today, the case is listed under the caption 'For Clarification' at the instance of the learned counsel for petitioner. 2.This Court, by the order dated 20.11.2025, had permitted the petitioner to travel to Republic of Seychelles with certain conditions. The petitioner is ready to comply with the conditions but with regard to Condition No.(iii) in para 7, a clarification is required, since in the order it has been stated that a sum of Rs.10 Crores to be deposited to the IDBI Bank for the loan account of M/s.Axcel Sunshine Limited.

3.The learned Senior Counsel for petitioner submitted that on the earlier occasion, along with the affidavit and documents, it was informed that the petitioner-company already initiated One Time Settlement proposal for Rs.120 Crores. Further, the amount of Rs.3.6 Crores deposited vide Demand Draft No.850074647 on 10.09.2022, Rs.6.4 Crores deposited through RTGS on 13.06.2024 and Rs.2 Crores deposited through RTGS on 11.04.2025. Hence, so far, a sum of Rs.12 Crores paid to the One Time Settlement Account No.12934915010017. Now this Rs.10 Crores to be credited in the One Time Settlement Account No.12934915010017. 4.The learned Special Public Prosecutor submitted that the petitioner to deposit the amount of Rs.10 Crores to the IDBI Bank and the same can be shown credit in the One Time Settlement account. It is for the bank to consider the one time proposal. He further submitted that one time settlement 3/7

proposal is yet to be accepted.

5.Today, the learned Senior Counsel for petitioner produced a letter dated 25.11.2025 received from the IDBI bank confirming that the petitioner already paid a sum of Rs.10 Crores towards the loan account of M/s.Axcel Sunshine Limited in compliance to the orders of this Court and the same is credited to the loan account.

6.His only apprehension is that in the event of One Time Settlement gets crystallised and accepted, this amount of Rs.10 Crores to be given credit to the One Time Settlement account. The petitioner's request can be considered by the IDBI Bank at the time of arriving One Time Settlement. On arriving at One Time Settlement, the Bank to give credit of Rs.10 Crores now credited in loan account pursuant to the order of this Court dated 20.11.2025.

7.The issue is clarified accordingly.
