Prayer: Writ Petition is filed under Article 226 of the constitution of India praying to issue a Writ of Mandamus directing the 2nd Respondent to measure and demarcate the petitioner's land acquired title under Sale Deed dated 30.11.1971, registration No. 1495/1971, situated in S.No15790, Kilangundal Village, measuring 3.27 acres of land, vide representation dated 6.11.2024.

The above Writ Petition has been filed seeking a mandamus to the second respondent to measure and demarcate the property of the petitioner in S.No.1570, Kilangundal Village, measuring an extent of 3.27 acres.
2.The case of the petitioner is that he is in possession of the aforesaid property since 30.11.1971 and has been carrying on agricultural work in the said property. He submitted a representation to the second respondent on 06.11.2024 to measure and demarcate the property but the second respondent has not conducted survey of the land in question. Hence, the petitioner is before this Court.
3. Heard the learned counsels on the either side and perused the records.

4. Considering the facts and circumstances of the case, a mandamus is issued to the second respondent to conduct a survey of the petition mentioned property. The petitioner shall submit all the relevant records to show his title to the property and the respondent shall, after issuing notice to the adjacent land owners and interested parties, hold an enquiry and thereafter, proceed to pass orders either surveying and subdividing the property or rejecting the request. In the case of a rejection, a speaking order shall be passed. The aforesaid exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is allowed. No costs.
