ORDER
The petitioner, who was arrested and remanded to judicial custody on 08.02.2025 in S.C.No.57 of 2025 on the file of the learned District and Sessions Court, Tirupattur, for the offences punishable under Sections 332(b), 118(2), 109(1) and 103(1) of BNS altered to Sections 103(1), 109(2), 118(2), 296(b), 332(1) and 3(5) of BNS in Crime No.55 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail applications of the petitioner was dismissed by this Court, vide order dated 07.07.2025 in Crl.O.P.No.18608 of 2025 and dismissed as withdrawn, vide order dated 03.09.2025 in Crl.O.P.No.21726 of 2025. 2.
The case of the prosecution is that, the petitioner along with other accused trespassed into the defacto complainant's sister's house, assaulted his sister and her husband using iron rod; that due to which, the defacto complainant's sister sustained grievous injuries and died on the spot; and that her husband was found throat slit and taken to hospital. Hence, this case.

The learned counsel appearing for the petitioner submitted that 2/4
the petitioner has been falsely implicated in this case and he is in judicial custody since 08.02.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that there was a dispute between the deceased and petitioner's mother with regard to a property; that due to which the petitioner along with other accused murdered the deceased and assaulted the husband of the deceased. He further submitted that the investigation completed, charge sheet filed and now the case is committed in S.C.No.57 of 2025 on the file of the learned District and Sessions Court, Tirupathur. He further submitted that yet another murder case in S.C.No.180 of 2022 is pending in Hosur Court and the petitioner is also facing life threat; and that the trial is pending.

Considering the facts, gravity of offence, the previous antecedents of the petitioner, there is no change of circumstances after dismissal of the earlier bail application in Crl.O.P.No.18608 of 2025 and the fact that the trial is pending, this Court is not inclined to grant bail to the petitioner.
