ORDER
The petitioner, who was arrested and remanded to judicial custody on 15.05.2025 based on execution of NBW dated 14.12.2016 in P.R.C.No.32 of 2015 and the case is committed to the Court of Sessions, pending before the Principal District and Sessions Court, Kancheepuram in S.C.No.103 of 2025, in connection with Crime No.185 of 2014 registered for the offences punishable under Sections 302 and 308 of IPC, seeks bail. 2.
The learned counsel appearing for the petitioner submitted that the petitioner was arrested and released on bail; that since the petitioner failed to appear before the committal Court in P.R.C.No.32 of 2025, a NBW was issued on 14.12.2016 and subsequently, the petitioner was arrested on 15.05.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner submitted that since the petitioner failed to appear before the Committal Court, a NBW 2/4
was issued and subsequently, he was arrested. He further submitted that the case has been committed to the Court of Sessions and pending before the Principal District and Sessions Court, Kancheepuram in S.C.No.103 of 2025. He further submitted that the petitioner was absconded nearly nine years pursuant to the non-bailable warrant issued against him; that there are 18 witnesses in this case and the trial is pending. 5.
Considering the facts of the case, taking note of the fact that the petitioner was absconded for nearly nine years and the trial process is pending, this Court is not inclined to grant bail to the petitioner at this stage.

Accordingly, this criminal original petition stands dismissed. 25.09.2025 stn 3/4
