O R D E R

This petition has been filed seeking a direction to the respondents 1 to 3 to grant permission to the petitioner for providing cable TV service for the total 336 residential housing units situated at Siddhapudur Phase I and Phase II region, Coimbatore.

2. It is the case of the petitioner that the petitioner has completed bachelor of engineering and providing cable TV connection service at Coimbatore for the past 5 years. He made an application before the first respondent on 18.11.2021 to grant permission for providing cable TV connections at newly constructed 224 residential houses at Siddhapudur Phase I region, Coimbatore and the same has not been considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider his representation and pass appropriate orders within the reasonable time as fixed by this Court.

4. The learned counsel for the respondents submitted that there are

three persons viz., one P.Murugesan, R.S.Prem Kumar and R.S.Deenadayalan made application for issuance of cable TV operator license before the first respondent. However, the first respondent has decided to give cable TV connection equally to one Murugesan and Deenadayalan. Both the persons have agreed to settle the issue with the Government. Therefore, the first respondent has allotted the connections to the NGO/self help groups.

5. Heard both sides and perused the materials available on record. Since no adverse order is passed against the private respondent, notice to the 4th respondent is dispensed with.

6. Considering the facts that the petitioner has made application before the first respondent for providing cable TV connections and the same was rejected by the first respondent vide order dated 05.02.2025. Without challenging the said order, the petitioner has filed only mandamus, which is not sustainable and the same is not maintainable. M.DHANDAPANI, J.

7. With the above direction, this writ petition is dismissed. No costs.
