ORDER

By consent of both the parties, this writ petition has been taken up for final disposal at the admission stage itself. Mr.Yogesh Kannadasan, learned Special Government Pleader takes notice for the respondents 1 and 2 and Ms.E.Ranganayaki, learned Additional Government Pleader takes notice for the 3rd respondent.

It is stated by the petitioner that he joined as Water Supplier Worker on 03.10.1988 and later appointed as Market Watchman Executive Officer, Attoor Panchayat Town, Kanniyakumari District, vide order of the respondent dated 15.05.1996 and on attaining the age of superannuation, he retired from service on 31.05.2023. It is the contention of the petitioner that he is entitled to pensionary / terminal benefits viz., gratuity, leave encashment, provident fund, etc. Though the pensionary benefits due to the petitioner were recommended for approval by the Executive Officer, the 2nd respondent, who is the competent authority has not acted so. Thereafter, he sent a representation dated 06.08.2025 to the respondents seeking for sanction of full pension and 2/5

other terminal benefits, but the same has not yet been considered by the respondents. Hence, he has approached this Court by filing this writ petition.

3. Heard the learned counsel on either side and perused the materials placed on record.

4. Learned counsel for the petitioner submitted that it would suffice, if a direction is issued by this Court to consider the petitioner's representation dated 06.08.2025 in the light of proceedings dated 08.11.2024 issued by the 3rd respondent, within a time frame to be fixed by this Court.

5. Acceding to the aforesaid submission, learned Special Government Pleader appearing for the respondents 1 and 2 would submit that the 1st respondent may be directed to consider the petitioner's representation, within a stipulated time to be fixed by this Court.

6. In view of the fair submissions, this Court, without going into the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 06.08.2025 on its own merits and pass orders in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition stands disposed of. No costs.
