This petition has been filed seeking to condone the delay of 407 days in filing the Civil Miscellaneous Appeal.

Mr.B.Siva Kollappan, learned counsel who takes notice on behalf of the second respondent, stated that he has no objection to this petition being allowed.

Though notice has been served on the first respondent and her name is printed in the cause list, there is no representation on her behalf.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 407 days in filing the appeal is condoned, subject to the condition that the claimant/petitioner will not be entitled to any interest for the delay period i.e., for 407 days, in the appeal. 5.

Registry is directed to number the Civil Miscellaneous Appeal, if it is, otherwise, in order and list the same for admission in due course and shall also print the name of the second respondent counsel in the cause list, at the time of admission.
