ORDER

This writ petition has been filed to directing the 3rd and 4th respondents to survey the measurement of petitioner property based on the online application dated 11.08.2023.

2. Mr.D.Ravichander, learned Special Government Pleader, takes notice on behalf of the respondents 1, 3 & 4 and Mr.L.Baskaran, learned Government Advocate, takes notice on behalf of the respondents 2 & 5. 2/6

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

The learned counsel for the petitioner would submit that in this case, initially, the subject property was purchased by the petitioner's father and thereafter, in the year 1951, the petitioner's father had settled the property in the name of petitioner's mother. After the demise of petitioner's mother, an online application dated 11.08.2023 was filed before the 3rd respondent for sub-division of the subject property and issuance of patta in the name of the petitioner. However, the said application was not considered by the respondents till date. Hence, this writ petition.

5. In reply, the learned Special Government Pleader appearing for the respondents would request this Court to pass appropriate orders directing the respondents to consider and dispose of the representation filed by the petitioner.

6. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and also perused the materials available on record.

In the case on hand, initially, the subject property was purchased by the petitioner's father and thereafter, in the year 1951, the petitioner's father had settled the property in the name of petitioner's mother. After the demise of petitioner's mother, an online application dated 11.08.2023 was filed before the 3rd respondent for sub-division of the subject property and issuance of patta in the name of the petitioner. However, the said application was not considered by the respondents till date.

In view of the above, this Court directs the respondents to consider the petitioner's application dated 11.08.2023 and dispose of the same on merits and in accordance with law after serving due notice to all the aggrieved persons, if any, within a period of 6 weeks from the date of receipt of copy of this order. If there is any obstruction in the process of 4/6

surveying the subject land, the respondents 1, 3 & 4 are at liberty to approach 2nd & 5th respondents, who shall provide all necessary assistance to them till the completion of process.

9. With the above directions, this writ petition is disposed of. No costs.
