Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, directing the respondents 6 to 8 to refund the amount deducted from the petitioner's salary towards Contributory Pension Scheme CPS during his Temporary Bond service rendered by the petitioner at the Government Hospital Padmanabhapuram, Kanyakumari District between July 2022 to May 2023 along with interest at the rate fixed by the Government for the period of service by the petitioner thereby considering his representation dated 11.4.2025 For petitioner : Mr.P. This writ petition has been filed to direct the respondents to refund the amount deducted from the salary of the petitioner towards Contributory Pension Scheme, during the Temporary Bond service rendered by the petitioner at the Government Hospital, Padmanabhapuram, Kanyakumari District between July 2022 and May 2023 along with interest at the rate fixed by the Government for the period of service by the petitioner by considering his representation dated 11.4.2025.

2. Mr.M. Bindran, learned Additional Government Pleader takes notice for the respondents.

3. In view of the consent expressed by the learned counsel on either side, this writ petition is taken up for final disposal at the admission stage itself.

4. It is brought to the notice of this Court that the issue involved in this writ petition has already been dealt with by a Coordinate Bench of this Court in the case of Dr. Syed Gafoor and 11 others vs. State of Tamil Nadu and 6 others (W.P. No.18188 of 2025 decided on 15.05.2025).

5. For the sake of ready reference, the relevant portion of the aforesaid order is reproduced as under :- 3/6

"3. The issue raised in this Writ Petition is covered by the order of this Court in W.P. No.12509 of 2025 etc., batch dated 08.04.2025. This Writ Petition is also disposed of in the same direction.

4. Accordingly, the respondents are directed to refund the amount to the petitioners within a period of twelve (12) weeks from the date of receipt of a copy of this order, failing which, the respondents shall be liable to pay interest at the rate of 18% per annum, calculated from the date on which the bond period concluded until the date of actual disbursement.

5. With the above direction, this Writ Petition is disposed of. No costs".

6. In such perspective of the matter, this writ petition also, is disposed of on the same terms. No costs.
