The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) and 20(b)(ii)(B) of NDPS Act in Crime No.274 of 2023, on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that, based on a secret information, the respondent police went to the spot and found that the accused person was in possession of 1.100 kilograms of ganja for the purpose of selling and other person escaped from the scene of occurrence, and on enquiry, it is found that the petitioner herein had involved in the purchase and selling of ganja. Hence, this case. 3.
Learned counsel appearing for the petitioner would submit that petitioner is innocent and has not committed any offence and falsely implicated in this case, based on the confession of the arrested accused. He would further submit that the petitioner is ready to produce solvent sureties 1/4
and to abide by any conditions that may be imposed by this Court and also undertake to appear and to co-operate for the investigation, therefore, he prayed for the grant of anticipatory bail to the petitioner. 4.
Learned Government Advocate (Crl. Side) appearing for the respondent police opposed for granting of anticipatory bail to the petitioner, stating that the co-accused and the petitioner were involved in illegal selling of 1.100 kilograms of ganja. He further submitted that the petitioner has 2 previous cases of similar nature.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record including the FIR. 6.
Taking note of the facts and circumstances of the case and the petitioner herein has 2 previous cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
Accordingly, this criminal original petition is dismissed. 2/4
