in H.C.P.No.2697 of 2019 R.SUBBIAH, J and R.PONGIAPPAN, J [Order of the Court was passed by R.SUBBIAH, J] Petitioner, who is the wife of the detenu viz., Ganesan @ Jangili Ganesan S/o.Lakshmipathy, aged 34 years, has filed the present petition seeking emergency leave to the detenu to do last rites for his mother, who expired today at 12.05 a.m.
2. Heard learned counsel for petitioner and learned Additional Public Prosecutor appearing for respondents.

Learned counsel for petitioner submits that the petitioner's mother has expired today at 12.05 a.m. and the funeral is going to be held on 20.12.2019 at No.69, 9th Street, Balramapuram, SIDCO Nagar, Villivakkam, Chennai - 600049. Learned counsel submits that the detenu is the only son and hence, he has to do all the last rites to his mother. Learned counsel further submits that the detenu is presently confined at Central Prison, Cuddalore.
4. Learned Additional Public Prosecutor appearing for respondents, on verification, affirms the submission of learned counsel for petitioner.
5. Considering the submissions made and taking into consideration the exigent 1/3
circumstance under which leave is sought for, this Court directs the Superintendent of Central Prison, Cuddalore, to release the detenu today at 04.00 p.m. with minimum escort and to bring back him to prison on 22.12.2019 at 05.00 p.m. The Criminal Miscellaneous Petition, accordingly, is ordered.
