This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 27 days in filing the above Criminal Revision Case against the order dated 28.02.2025 passed in C.M.P.No.6 of 2024 in M.C.No.3 of 2018, on the file of Family Court, Udhagamandalam.

2. Mr.B.Gopalakrishnan, learned counsel for petitioner submitted that as he is aged about 54 years, he had suffered with age related ailments and also due to heavy financial constraints, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of August 2025, he gave papers to him, as a result of which, there is a delay of 27 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
