Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondent to consider the representation dated 01.08.2025 and pass appropriate orders on the promotion of the writ petitioner as Assistant Divisional Engineer from the date of completion of acquiring the educational qualification and other criteria i.e., 29.08.2015 within a stipulated time.

ORDER

By consent of both the parties, this writ petition has been taken up for final disposal at the admission stage itself. Mr.K. Surendran, learned Additional Government Pleader takes notice for the respondents.

The case of the petitioner is that he was appointed as an Assistant Draughtsman on 16.08.2001 and thereafter he was promoted as Junior Draughting Officer on 22.12.2004 and presently he is working as Junior Engineer. It is the contention of the petitioner that the next avenue of promotion is Assistant Divisional Engineer and he is fully eligible for the said promotion. It is the grievance of the petitioner that his claim for promotion was never considered and in such a scenario, he submitted a representation on 01.08.2025 to the respondents. As the said representation did not evoke any response, the petitioner has approached this Court by filing this writ petition.

3. Heard the learned counsel on either side and perused the materials placed on record.

Though very many grounds have been raised in this writ petition, this Court is of the view that it is suffice to direct the second respondent to consider representation dated 01.08.2025 and pass orders on its own merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion

on the merits of the claim made by the petitioner. 5.
