ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus to direct the respondent to consider the petitioner's representation dated 25.09.2023 within a specific time frame fixed by this Court.

2. Heard Mr.S.Sivakumar, learned counsel for the petitioner and Mr.K.Karthik Rajan, learned Government Advocate (HR & CE) for the respondent.

3. The petitioner along with other village public has given a representation to the respondent to take action against one Sundareswarar Sivam who was appointed as Poosari in Arulmigu Soleswarar temple, Pudur, Erode District, for stealing deities from the temple. Since no action is seen to be forthcoming from the respondent, the petitioner is before this Court.

4. It is learnt from the submission made by the learned Government Advocate (HR & CE) for the respondent that after having made an enquiry, the respondent has given a police complaint as early as on 06.05.2023. Once the police complaint is given it is for the police to take action.

5. It is further submitted by the learned counsel for the petitioner that the person against whom the allegation was made, is still continuing as Poosari in the said temple.

6. However, the learned Government Advocate for the respondent submitted that the said person has already been relieved from the post and now, the functions of Poosari is being carried out by some other person.

7. In view of the above change as submitted by the learned Government Advocate, there cannot be more grievance for the petitioner. Page No.3 of 6

Since the respondent has given a police complaint, it is upto the investigation authority to take further action.
