DATED: 06.10.2025
CORAM:
THE HONOURABLE MR. JUSTICE D.BHARATHA CHAKRAVARTHY Suo Motu TR.No.15547 of 2025 (CC.300024/2018 of Judicial Magistrate Court No.II, Tambaram Taluk, Chengalpattu) For Petitioner : Mr.S.Sugendran Additional Public Prosecutor
ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The allegation in this case is that on 31.03.2017, the accused protested against a political party without due permission. A case was registered in Cr.No.563 of 2017 on 31.03.2017 for the alleged offence under Sections 143, 188 and of I.P.C and Section 74 of TN City Police Act, 1888. The final report was filed on 29.08.2017, and the accused have been facing trial since then. Thus, it can be seen that the allegations concern exercising the democratic right to protest. Given the context and nature of allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case.
