ORDER
These Suo Motu Cases are dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.These cases in Cr.Nos.05, 03, 06, 04 and 07 of 2018 were registered for the alleged offences under Section 3(a) RP(UP)Act 1966. In all these cases, the accused were found to be in possession of various quantities of railway properties and hence all these cases came to existence at the same time. The property has been recovered and handover to the railways on behalf of the said organization. It is represented that they are unable to trace the accused and they have no objection in the case being closed.
3. Considering this as an extraordinary case since there is no other case subsequent to the said period and the accused remaining elusive, the cases are pending in summons stage. it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. shl 4.Accordingly, the cases in CC.Nos.101, 102, 103, 104 and 105 of 2022 on the file of the District Munsif Cum Judicial Magistrate Court, Gummidipoondi Taluk, Tiruvallur stands quashed. These Suo Motu Transfer Cases are disposed of.
23.10.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
