ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The cases in C.C.Nos.661 of 2010 and 2 of 2012 was taken on the file of the Judicial Magistrate No.3, Erode Taluk, Erode for the alleged offence under Sections 120-B, 420 and 109 of I.P.C. This is an occurrence of the year 2002. The allegations against the accused is that the accused persons got a sum of Rs.50,000/- from the public by giving assurance to provide a computer related job. It is stated that the case is split up as against the first/main accused in this case and he admitted the crime and also convicted and underwent the sentence. As far as these accused are concerned, they have attending and facing the case from the year 2002.

3. In view of the sheer efflux of time of 23 years, the trial could not be proceeded further as against these accused and the matter is kept pending for want of records. Considering the fact that the allegations are primarily against the accused No.1 and who has already admitted the crime, convicted and underwent the sentence and said to have been released from prison. Since the accused facing the proceedings for more than 23 years, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served. 4.Accordingly, the cases in C.C.Nos.661 of 2010 and 2 of 2012 was taken on the file of the Judicial Magistrate No.3, Erode Taluk, Erode stands quashed. This Suo Motu Transfer Case is disposed of. 10.10.2025 mp electronically alone.
The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
