The petitioner/A2 who was arrested and remanded to judicial custody on 25.11.2023, for the offences originally registered under Section 174 Cr.P.C and subsequently, altered to Sections 323, 304(ii), 201 of IPC in Crime No.846 of 2023 on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that the deceased had been admitted in Green Life Rehabilitation Centre for treatment of drug addiction. It was reported that he died. The wife of the deceased requested to show the victim through video call but later it was found during the postmortem that there were as many as 6 antemortem injuries including contusion injuries on the chest. 3.It is therefore evident that the accused persons had caused injuries and later, the deceased died.

4.The learned counsel for the petitioner stated that the deceased is a drug addict.

5.But if they are not able to treat a person from drug addiction, they should not have opened a rehabilitation centre at all. They have a duty to take care in proper manner.

Vkr 6.Taking all the factors into consideration, at this stage, I am not inclined to grant bail to the petitioner.
