ORDER
The petitioner, who was arrested and remanded to judicial custody on 25.01.2025, for the offence under Sections 8(c),20(b)(ii)(c), 25 and 29(1) of NDPS Act, 1985 in Crime No.52 of 2025, registered on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner joined hands with other accused and have transported ganja from Karnataka to Tamil Nadu in Mahindra Jeep and two wheeler. Based on the specific information received the respondent police intercepted the alleged vehicle and three bags of ganja were recovered from the petitioner and other persons and registered a case against the petitioner and other accused. 3.The learned counsel appearing for the petitioner submitted that the petitioner is suffering from asthma and he is taking treatment. He further submitted that only based on the confession given by the co-accused the petitioner has been implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for 2/4
the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the case is being numbered and taken on file. He further submitted that this is the second bail application and the earlier bail application in Crl.O.P.No.18448 of 2025 was dismissed by this Court on 14.08.2025.
6. In view of the above facts and the petitioner has not satisfied twin conditions under section 37 of NDPS Act and further the petitioner has not produced medical records with regard to his health issues and this is the second bail application and the earlier bail application in Crl.O.P.No. 18448 of 2025 was dismissed by this Court on 14.08.2025 and there is no change in circumstances this Court is not inclined to grant bail to the petitioner.
