O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 304(2) of BNS in Crime No. 156 of 2025, on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused had snatched the cellphone from the de-facto complainant and fled. 1/6

Hence the complaint.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that the petitioner along with other co-accused had robbed the mobile phone from the de-facto complainant. He further submits that the property has not yet recovered from the accused and one previous case in respect of 302 of IPC is pending against the petitioner herein. Therefore, he opposed for grant of anticipatory bail to the petitioner.

5. Taking into consideration of the fact that one previous case u/s. 302 2/6

of IPC is pending against the petitioner herein; gravity of the offence committed by the petitioner; the property has not yet recovered from the accused and investigation is not yet completed; and hence, this Court is not inclined to allow this Criminal Original Petition.

6. Accordingly, this Criminal Original Petition is dismissed. 22.09.2025 MSM To 1.The Judicial Magistrate No.2, Udumalaipettai. 2.The Inspector of Police Dhally Police Station Tiruppur.
