J.,] Captioned main 'Writ Petition' ['WP' for the sake of brevity] was filed by one Mr.K.P.Jayaraman, S/o.Panchan, pending main WP Mr.K.P.Jayaraman died on 10.12.2023 leaving behind six legal heirs viz., wife, four sons and one daughter, the details of which are as follows: SI.No.

2. Captioned 'Writ Miscellaneous Petition' ['WMP'] has been taken 1/4

out with a prayer to substitute the aforementioned six legal heirs of Mr.K.P.Jayaraman as writ petitioners in place of deceased Mr.K.P.Jayaraman.

3. Before we proceed further we are constrained to write that the prayer is not happily worded as it reads as follows: 'For the reasons stated in the accompanying affidavit it is humbly prayed that this Hon'ble Court may be pleased to substitute the petitioner herein Legal Heir of original petitioner K.P.Jayaraman as a petitioner and Respondents 5 to 9 in W.P.No.11344 of 2021 on file of this Hon'ble Court and thus render Justice.'

Nonetheless in sum and substance, the aforementioned six legal heirs of Mr.K.P.Jayaraman have to be substituted as writ petitioners in place of lone writ petitioner Mr.K.P.Jayaraman and more importantly, Mr.M.S.Arasa Kumar, learned Government Advocate for Respondents 1 and 3 and Mr.M.Rajamathivanan, learned counsel representing Ms.P.Shanthi, counsel on record for R2 do not oppose the captioned 2/4

WMP. To be noted, R4 has been duly served and name of R4 is shown in the cause list as regards main writ petition but R4 has not chosen to come before this Court and resist or oppose/contest the main WP. Therefore, considering the facts and circumstances of the instant case, also taking into account the innocuous substitution prayer and further taking into account the fact that the substitution prayer is not opposed by any of the contesting respondents, we allow the captioned WMP. Registry to carry out necessary and consequential amendments in the case file forthwith.
