The Civil Revision Petition is filed seeking direction to the learned District Munsif cum Judicial Magistrate, Sriperumbudur to expeditiously 1/4
dispose the case in O.S.No.73 of 2020.
2. In view of the limited prayer made by the petitioner, this Court is inclined to dispose the Civil Revision Petition even without notice to other side.
3. The respondents 1 to 3 herein filed a Suit seeking declaration that the settlement dated 17.06.2005 vide Doc. No.2151 of 2005 on the file of the Sub-Registrar, Padappai and also for a further declaration that release deed dated 04.10.2010 vide Doc. No.5034 of 2010 on the file of Sub-Registrar, Padappai are illegal, null and void and not binding on the plaintiffs. It is seen from the e-courts print outs included in the typed set of papers that the petitioner herein filed an application seeking rejection of the plaint in I.A. No.1 of 2021 and the same has been adjourned from 07.12.2023 to 09.01.2024 for filing of counter without much progress. Hence, the petitioner has come forward with this revision seeking early disposal of the Suit.
4. When the petition filed by the revision petitioner seeking rejection of the plaint in I.A. No.1 of 2021 is still pending, this Court is not inclined to 2/4
issue any direction to dispose of the main Suit. However, in view of the fact that the interlocutory application seeking rejection of the plaint is of the year 2021, this Court is inclined to direct that the I.A. No.1 of 2021 shall be disposed of as expeditiously as possible.
5. With this direction, the Civil Revision Petition stands disposed of. No costs.
