Challenging the order passed in SplS.C.No.83 of 2020 on the file of Sessions Judge, Magalir Neethimandram (Fast Track Mahila Court), Tiruppur, the petitioner preferred the above Criminal Appeal, however there is a delay of 398 days in representing the above Criminal Appeal arose. Hence, the present petition has been filed to condone the delay in representing the Crl. Appeal.

2. Ms.V.Alamelu, learned counsel for petitioner submitted that the above Criminal Appeal was returned for rectifying certain defects on 11.07.2024. He would submit that due to delay in obtaining typed set of papers as well as e-challan for the payment of fine amount made by the petitioner, who was confined in Central Prison, Coimbatore, counsel on record is not able to represent the above appeal within a stipulated time. Hence, there is a delay of 172 days arose in representing the above second appeal and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances and on considering the reasons stated by the petitioner in the affidavit that the bundle was misplaced, to give one more opportunity to the petitioner, this court is inclined to allow this petition.
