PRAYER This Writ Petition has been filed seeking for issuance of a Certiorarified Mandamus, to call for the records connected with the University pertaining to the order of third respondent in No.A2/015393/2025 dated 10.09.2025 (in so far petitioner is concerned) and the consequential order of second respondent herein issued in University Order No.504/2025(C) dated 15.09.2025 and quash the same and consequently direct the 1st and 2nd respondents to allow the petitioner to continue in the same place.

ORDER

This Writ Petition has been filed seeking for issuance of a Certiorarified Mandamus, to call for the records connected with the University pertaining to the order of third respondent in No.A2/015393/2025 dated 10.09.2025 (in so far petitioner is concerned) and the consequential order of second respondent herein issued in University Order No.504/2025(C) dated 15.09.2025 and quash the same and consequently direct the 1st and 2nd respondents to allow the petitioner

to continue in the same place.

2.The case of the petitioner is that she was appointed as a Lecturer in the second respondent University on 17.03.1999 and she was working as a Professor until the date of her transfer i.e.,15.09.2025. The petitioner has put in 26 years of service in the second respondent University. On 10.09.2025, the third respondent issued an order, transferring the petitioner to Thovalai, Kanyakumari District, although she being the seniormost Professor in her Department, leaving the juniors. On 15.09.2025, the second respondent relieved her from duties by giving her seven days time to join in the transferred post. Aggrieved over the impugned orders of the second and the third respondents, the petitioner was constrained to file the present Writ Petition. 3.The learned counsel for the petitioner would submit that the petitioner is the seniormost Professor, while so, leaving her juniors, more particularly, one Ms.V.Arivoli, the petitioner has been transferred from Cuddalore District to Kanyakumari District, which cannot be sustained.

4.The learned counsel for the second respondent would submit that the transfer order has been issued pursuant to G.O.(D) No.226, Higher Education(H1) Department dated 26.08.2025, declaring the petitioner as surplus Professor and she has been redeployed to the present station. The learned counsel would further submit that as far as Ms.V.Arivoli is concerned, she is a physically challenged person and she has given a representation to the Department of Welfare of the Differently Abled Persons and on the recommendations of the same, the Government has considered her case independently and retained her. Further, except Ms.V.Arivoli, other staff members were already redeployed and they had also joined in their respective stations. He would further submit that the transfer is an incident of service and it is in the interest of the administration, but not punitive in nature and hence he would seek to dismiss this writ petition.

5. Heard the learned counsel on either side and perused the materials available on record.

6. From the records, it is seen that the petitioner has been redeployed by way of transfer pursuant to G.O.(D) No.226, Higher Education(H1) Department dated 26.08.2025. In such view of the matter, I do not find any infirmity in the order of the third respondent vide No.A2/015393/2025 dated 10.09.2025 insofar as the petitioner is concerned and the consequential order of second respondent herein issued vide University Order No.504/2025(C) dated 15.09.2025.

7. Since transfer is an incident of service in every employee's career, he/she may be transferred from one place to another as per the Rules of service. In the present case as already alluded to supra, the petitioner has been redeployed by way of transfer pursuant to the Government order dated 26.08.2025 after declaring her as surplus. However, in the event of the petitioner making any representation to the respondents, the same shall be considered by the Government.

8. This Writ Petition is dismissed with the aforesaid observation and

direction. No costs. Consequently, connected miscellaneous petitions are closed.
