Mrs.J.R.Archana, GA(Crl.Side) ADVANCE ORDER The appeal is allowed in-part and the conviction and sentence imposed on the appellant/accused namely Prathap @ Apple, S/o.Ravishankar by the learned Sessions Judge, Magalir Neethimandram (FTMC), Udhagamandalam at Nilgiris in Spl.CC.No. 6 of 2017 by judgment dated 29.11.2018 stands modified and the

appellant/accused is found guilty for the offences under Sections 4 of POCSO Act and 506(i) of IPC and sentenced to undergo imprisonment for a period of seven years for the offence under Section 4 of POCSO Act (as its stood prior to Amendment Act 25 of 2019) and to pay a fine of Rs.1,000/-(Rupees one thousand only) in default to undergo simple imprisonment for one month and one year for the offence under Section 506(i) of IPC and the sentences shall run concurrently. Now that the appellant/accused, viz., Prathap @ Apple, S/o.Ravishankar has already undergone incarceration for more than 7 1⁄2 years, he is directed to be set at liberty forthwith, unless his presence is required in connection with any other case.
