Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 and 2 to issue suitable instructions to the 4th respondent to issue land priority quota certificate to the petitioner and thereby further direct the respondents 1, 2 & 6 to sponsor for the petitioner for considering appointment in any one of the Department of the State.

This writ petition has been filed for the issue of writ of Mandamus directing the respondents to consider the representation made by the petitioner and pass appropriate orders by giving her a priority quota and to the persons displaced due to land acquisition proceedings. 2.

The case of the petitioner is that the lands belonging to the grandfather of the petitioner was acquired and there was a promise to provide employment to one of the dependent in the family. The 3rd respondent issued a notification inviting applications to the post of Scientific Assistant in the year 2011. The petitioner had submitted her application and thereafter, she was not considered for employment. 3.

The petitioner made a representation in the year 2014 seeking for priority in employment and the same was not considered. Subsequently, the petitioner has found that there is a vacancy in the post of Scientific Assistant and therefore, now she has approached this Court on the ground that she is entitled to be considered for appointment under the priority quota. 4.

Heard the learned counsel for the petitioner and the learned counsel for the respondents.

This Court is not inclined to entertain this writ petition for the simple reason that the petitioner cannot claim as a matter of right to be appointed as a Scientific Assistant only on the ground that there are vacancies available in the Department of the Atomic Energy. The petitioner participated in 2/4

the selection in the year 2011 and failed to get selected. The petitioner is now aged about 43 years and at this length of time, the petitioner cannot be allowed to seek any employment as a matter of right only on the ground that the land belonging to her grandfather was acquired and she as a dependent is entitled for appointment. This writ petition is hit by latches and this Court also does not find any legal right for the petitioner to seek for such a relief.
